Dear Mr. Persinko:
As discussed during the phone conversation of 15 May (Ref. 6). GE Hitachi Nuclear Energy Americas, LLC., (GEH) Vallecitos Nuclear Center (VNC) is withdrawing its request (Ref. 6) for an exemption from the emergency planning requirements of 10CFR50.
Also from the conversation with NRC during the 15 May phone call, VNC has evaluated the applicability of 10CFR50 emergency preparedness requirements to our specific facility and have determined that no changes are required for the emergency preparedness plan already in place for the shutdown reactors at the site (Ref 1-3).
The basis for this determination is as follows. GEH has three shutdown reactors at the VNC site under the provisions of NRC licenses mentioned as references 1-3 above. These GE Hitachi Nuclear Energy
SID Rx EP Rule Compliance 24 May 2013 Page 2 of 2 reactors are all in a de-fueled, SAFSTOR condition, with no active or on-going operations. No fuel assemblies from these reactors remain on-site. There are no personnel assigned specifically to these reactors. All systems are dry. Only residual contamination exists.
Reactors under license DPR-1, Docket 50-018 (VBWR) and license DR-10, Docket 50-183 (EVESR) have undergone extensive source reduction work and only a few components remain within the containments. The facility under license TR-1, Docket 50-070 (GETR). is also defueled and dry. A source reduction program is not yet completed and component removal has not yet begun.
Contamination levels in all reactors are significantly reduced from when the reactors were shut-down and well below typical operating research reactors. The highest recorded general area dose rates are approximately 60 mr/hr and the highest general area contamination levels are approximately 95,000 dpm/ftz.
VNC maintains a site emergency preparedness plan using the requirements for research reactors as detailed in Regulatory Guide 2.6 and ANSI/ANS Standard 15.16. VNC has determined using this emergency preparedness plan is sufficient in attaining an acceptable state of emergency planning and preparedness involving the shutdown reactors.
