Docket No. 50-443-LR ASLBP No. 10-906-02-LR-BD01 May 21, 2013 MEMORANDUM AND ORDER (Granting NRC Staffs Motion for Extension of Time)
For good cause shown, the NRC Staffs unopposed motion1 for an extension of time, until July 15, 2013, to file its answers to two pending summary disposition motions2 is granted.
Intervenors request for identical extensions is also granted. Although the Applicant opposes Intervenors request for equal time, the Board does not expect to rule before it has the benefit of the Staffs views. Therefore, allowing Intervenors an equal extension of time in which to respond to the pending summary disposition motions will result in little if any further delay.
We remind the parties that the relevant test is whether the summary disposition motions show that there is no genuine issue as to any material fact and that the moving party is entitled 1 See NRC Staff Motion for Extension of Time to File Answers to NextEra Motions for Summary Disposition of Contentions 4B & 4D (May 20, 2013).

to a decision as a matter of law.3 Notwithstanding the length of the requested extensions, the Board expects the answers to the pending motions to focus succinctly on that issue.
