Dear Mr. Shadis:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter of April 30, 2013, on seismic analysis of spent fuel pool storage risk. You requested that the NRC consider utilizing pilot projects in its on-going Waste Confidence rulemaking effort and select Vermont Yankee as a representative boiling-water reactor for any such pilot projects.

Please note that in the matter of Waste Confidence, the NRC does not plan to conduct any specific pilot projects as part of the on-going generic environmental impact statement (GEIS) and rulemaking process. The NRC will, however, continue to perform oversight of spent fuel storage through its normal processes, as well as continue its various research activities to further inform decision-making.

The NRC has scheduled the Waste Confidence draft generic environmental impact statement and proposed rule for publication by September of 2013 (please see http://www.nrc.gov/waste/spent-fuel-storage/wcd/schedule.html for the latest schedule). The NRC staff will seek public comment on the proposed rule and draft generic environmental impact statement in the September to November timeframe. The NRC will accept comments at regional public meetings held throughout the United Statesincluding one in the Boston metropolitan area as well as seven other locationswith two nationally webcast meetings at NRC headquarters. The NRC will also accept comments online at www.regulations.gov, via e-mail, via fax, and via U.S. Mail during the comment period.

The NRC will provide specific meeting information for all locations as soon as it is available. We will post this information to our Waste Confidence webpages (available from www.nrc.gov via link in the Spotlight box), provide it on the monthly Waste Confidence status teleconferences, and distribute it to the WCOutreach@nrc.gov e-mail list.

I encourage you to review the draft GEIS and proposed rule, and to provide your insights and comments to the NRC staff through the various opportunities described above. I appreciate your time and attention in reaching out to me to share your views on this matter.
