REQUEST FOR LIST OF FEDERAL PROTECTED SPECIES WITHIN THE AREA UNDER EVALUATION FORTHE SHINE MEDICAL TECHNOLOGIES RADIOISOTOPE PRODUCTION FACILITY ENVIRONMENTAL REVIEW
Dear Mr. Fasbender:
The U.S. Nuclear Regulatory Commission (NRC) is conducting an environmental review of a construction permit application submitted by SHINE Medical Technologies. Inc. (SHINE). for a proposed radioisotope production facility. The application for a construction permit was submitted by SHINE in a letter dated March 26. 2013, pursuant to Title 10 of the Code of Federal Regulations Part 50 (10 CFR Part 50). This facility, if licensed. would produce radioisotopes for use in diagnostic medical isotope procedures. The proposed location of this facility is approximately 4 miles south of Janesville, Rock County. Wisconsin (see Enclosures 1 and 2).
The NRC has established that, as part of the staff's review an environmental impact statement (EIS) will be prepared under 10 CFR Part 51, the NRC's regulation that implements the National Environment Policy Act of 1969. as amended (NEPA). The EIS will include an analysis of pertinent environmental issues, including endangered or threatened species, migratory birds, and other impacts to ecological resources. This letter is being submitted under the provisions of the Endangered Species Act of 1973, as amended. and the Fish and Wildlife Coordination Act of 1934.
SHINE proposes to construct and operate a radioisotope production facility to produce molybdenum-99 (Mo-99), iodine 131 (1-131), and xenon-133 (Xe-133). The proposed site would cover approximately 91 ac (37 ha). which would include open space, a production facility building, a support facility building. a waste staging and shipping building. a diesel generator building, an administration building. and a security station (see Enclosure 3). The majority of the proposed site consists of cultivated agricultural land and the remaining portion of the site includes some developed areas and open space (SHINE 2013). Other agricultural land or open spaces borders the proposed site to the south, east. and nOi1h and U.S. Highway 51(US 51) borders the western boundary of the proposed site. The Southern Wisconsin Regional Airport is located immediately to the west of US 51.
Due to previous agricultural use at the proposed site. the site does not include forest, wetlands, grasslands, or prairie habitats (SHINE 2013). In addition, no ephemeral. intermittent, or perennial streams and associated riparian zones are located within the boundaries of the

-3 SHINE site (SHINE 2013). In its environmental report to the NRC, SHINE indicated that no groundwater or surface water would be used during construction,operation, or decommissioning. Instead, the Janesville municipal water system would supply water for the SHINE facility.
In addition to the proposed site, SHINE evaluated the environmental impacts for two reasonable alternative sites: Chippewa Falls and Stevens Point (SHINE 2013). The Chippewa Falls site is located in the City of Chippewa Falls in Chippewa County, Wisconsin. The site would be located within the Wissota Lake Business Park and most of the site is agricultural land (Enclosure 4). The Stevens Point Site is located in Portage County, Wisconsin, adjacent to the City of Stevens Point (Enclosure 5). The site is a combination of wooded and agricultural land.
The SHINE construction permit application is available through the Agencywide Documents Access Management System (ADAMS) Public Electronic Reading Room, which is accessible at http://www.nrc.govlreading-rmladams.html. From this page, the public can gain entry into ADAMS, which provides text and image files of NRC's public documents. The ADAMS Accession Number for the SHINE construction permit application (Part 1) is ML130880226. The environmental report is Chapter 19 of the SHINE construction permit application.
To support the EIS preparation process and to ensure compliance with Section 7 of the Endangered Species Act, the NRC staff requests information on federally-listed, proposed, and candidate species and critical habitat that may be in the vicinity of the SHINE site and the two alternative sites. In addition, please provide any information you consider appropriate under the provisions of the Fish and Wildlife Coordination Act.
The NRC plans to hold two public environmental scoping meetings on July 17,2013, at the Rotary Botanical Gardens, 1455 Palmer Drive, Janesville, Wisconsin 53545. The first meeting will begin with an open house from 12:30 p.m. until 1:30 p.m., followed by an NRC staff presentation and opportunity to hear public comments from 1 :30 p.m. until 3:30 p.m., as necessary. The second meeting will begin with an open house from 6:00 p.m. until 7:00 p.m.,
followed by a repeat of NRC staff's earlier presentation and opportunity to hear public comments from 7:00 p.m. until 9:00 p.m., as necessary. In addition, during the week of July 29,2013, the NRC staff plans to conduct a site audit near the proposed SHINE facility.
You and your staff are invited to attend both the site audit and the public meetings. Your office will receive a copy of the draft EIS along with a request for comments. The NRC expects to publish the draft EIS in spring 2014. After consideration of public comments received, the NRC staff will prepare a final EIS, which is scheduled to be issued in winter 2015.
