Dear Mr. Pacilio:

1 By letter to the U.S. Nuclear Regulatory Commission (NRC), dated February 13, 2013, Exelon Generation Company, LLC submitted an affidavit dated January 14, 2013, executed by Gayle F.

Elliott, Manager, Product Licensing, AREVA NP, Inc., requesting that the information contained in the following documents be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 2, Section 2.390:

  • Calculation Summary Sheet (CSS) 32-9186204-000, "Quad Cities Unit 2 Reactor Vessel Instrumentation Nozzle Modification Section III Analysis," dated September 2012
  • CSS 32-9186722-000, "Quad Cities Unit 2 RV Instrument Nozzle J-Groove Weld Residual Stress Analysis," dated October 2012
  • CSS 32-9193800-000, "Quad Cities Unit 2 Instrument Nozzle J-Groove Weld Flaw Evaluation Using Finite Element," dated December 2012
  • AREVA NP Report 33-9114561-000, "ASME Design Report Certification Document Contract No. F.501472," dated September 2012
  • Engineering Information Record 51-9180871-001, "ASME Section XI Reconciliation for Quad Cities Unit 2 Reactor Vessel Nozzle N-11 B Modification,"

dated December 2012

  • Engineering Information Record 51-9180975-002, "Corrosion Evaluation of the Quad Cities Unit 2 N11-B Reactor Vessel Nozzle Modification," dated July 2012 The affidavit stated that the documents listed above should be considered exempt from mandatory public disclosure for the following reasons:
1. The information includes test data or analytical techniques concerning a process, methodology, or component, the application of which results in a competitive advantage for AREVA NP.
2. The information reveals certain distinguishing aspects of a process, methodology, or component, the exclusive use of which provides a competitive advantage for AREVA NP in product optimization or marketability.

M. Pacilio - 2 The NRC staff has reviewed your application and the material in accordance with the requirements of 10 CFR 2.390. Your February 13, 2013, letter included a copy of CSS 32 9193800-000, but did not include any of the other documents listed above. On the basis of the statements in the affidavit, the staff has determined that the information submitted with the February 13, 2013, letter sought to be withheld contains proprietary commercial information and should be withheld from public disclosure. However, the NRC staff cannot make a determination about the proprietary nature of the documents listed above which were not submitted with the February 13, 2013, letter. A determination regarding these other documents will be made if, and when, they are submitted.

Therefore, CSS 32-9193800-000, "Quad Cities Unit 2 Instrument Nozzle J-Groove Weld Flaw Evaluation Using Finite Element," dated December 2012, marked as proprietary, will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
