Dear Mr. Anders:

Thank you for your letter dated January 16, 2013, acknowledging receipt by the New York State Department of State (NYSDC) of the certification (Consistency Certification) by Entergy Nuclear Indian Point 2, LLC, Entergy Nuclear Indian Point 3, LLC, and Entergy Nuclear Operations, Inc. (collectively, Enter2y) that issuance by the United States Nuclear Regulatory Commission (USNRC) of 20-year renewed operating licenses (License Renewal) for Indian Point Energy Center Unit 2 and Unit 3 is consistent with all applicable and enforceable policies of the New York State Coastal Management Program.

It has come to our attention that Attachment 16 of the Consistency Certification, a letter dated September 24, 2009, filed with USNRC as document # NL 131, was missing pages 13 of 14, and 14 of 14. We therefore enclose the missing pages 13 of 14 and 14 of 14 for your files.

We are also enclosing for your records a copy of the Endangered Species Act Section 7 Consultation Biological Opinion for Continued Operations of Indian Point Nuclear Generating Units Nos. 2 and 3 dated January 30, 2013, provided by the National Oceanic and Atmospheric Administration National Marine Fisheries Service to the USNRC.

Your January 16, 2013, letter requests a copy of the Final Environmental Impact Statement for License Renewal (the Request for Necessary Data and Information). Entergys submittal did include a copy of the Final Environmental Impact Statement prepared by USNRC for License Renewal (Attachment 22). In addition, Entergys submittal included the draft supplemental environmental impact statement, Volume 4, issued by USNRC to supplement the Final Environmental Impact Statement and to respond to information received by USNRC after completion of the Final Environmental Impact Statement (Attachment 56). The final supplemental environmental impact statement, Volume 4, requested by the Request for

NL-13-047 Page2of2 Necessary Data and Information does not yet exist, and therefore Entergy is unable to submit it at this time.

USNRC staff have advised the Atomic Safety and Licensing Board that issuance of the final supplemental environmental impact statement sought by the Request for Necessary Data and Information is anticipated on or about April 30, 2013. Entergy will submit the report to NYSDOS when it is issued by USNRC.
