ASLBP No. 07-858-03-LR-BD01 (Indian Point Nuclear Generating Units 2 and 3) April 4, 2013 ORDER (Denying NRC Staffs Motion for an Extension of Time)
On April 2, 2013, the NRC Staff filed an unopposed motion seeking an extension of time to file its response to Applicants motion for a declaratory order concerning the Coastal Zone Management Act.1 Entergy Nuclear Operations, Inc., the State of New York, and Riverkeeper, Inc. do not oppose the NRC Staffs motion.2 However, it appears that the NRC Staff was unable to reach Counsel for Hudson River Sloop Clearwater, Inc. (Clearwater) prior to filing its motion.3 On its face, the NRC Staffs motion appears reasonable and the Board is predisposed to granting the motion in favor of the NRC Staff. However, the Commissions regulations require more from the NRC Staff before the Board is able to rule on the merits of the pending motion.

Under 10 C.F.R. § 2.323(b), [a] motion must be rejected if it does not include a certification by the attorney or representative of the moving party that the movant has made a sincere effort to contact other parties in the proceeding and resolve the issue(s) raised in the motion, and that the movants efforts to resolve the issue(s) have been unsuccessful.4 The NRC Staff merely represented that it attempted to contact Counsel for Clearwater but was unable to reach her prior to the filing of this motion.5 The NRC Staffs representation does not meet the requirements of 10 C.F.R. § 2.323(b).
At this juncture, the Board is unable to determine the sufficiency of the attempted consultation and must conclude that the NRC Staff has not shown that a sincere effort was made to contact Clearwater. The Board needs sufficient information from which we can find that the movant has made a sincere effort to contact other parties . . . .6 Without knowing when in relation to the filing of the motion and how contact was attempted, we cannot make such a finding.
Accordingly, the NRC Staffs motion is DENIED. However, the Board will expeditiously review a second motion if filed by the NRC Staff.
It is so ORDERED.
