STAFF ACCEPTANCE OF NEI-06-06, FITNESS FOR DUTY PROGRAM GUIDANCE FOR NEW NUCLEAR POWER PLANT CONSTRUCTION SITES, REVISION 6, FOR ENDORSEMENT THROUGH REGULATORY GUIDANCE DEVELOPMENT PROCESS
Dear Mr. Kline:
The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed the Nuclear Energy Institutes (NEIs) draft guidance document entitled NEI 06-06, Revision 6, Fitness for Duty Program Guidance for New Nuclear Power Plant Construction Sites, dated May 2012 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML12136A527). The purpose of NEI 06-06 is to establish program-level consistency throughout the nuclear power industry in the implementation of Title 10 of the Code of Federal Regulations (10 CFR) Part 26, Subpart K, FFD Programs for Construction.
On March 7, 2013, a public meeting was held to discuss NRC staff comments on this document (ADAMS Accession No. ML13078A333). Specifically, NRC staff did not agree with the expanded scope of the Fitness for Duty program for construction to include those individuals specified in 10 CFR 26.4(e) (e.g., persons who perform quality assurance/verification activities).
By correspondence dated April 2, 2013 (ADAMS Accession No. ML13093A331), NEI provided NRC with an updated version of NEI 06-06, Revision 6, dated April 2013, which incorporates staff comments provided during the March 7, 2013, public meeting. However, this NEI document still includes the expanded scope language for which NRC takes exception.
Based on its review, the NRC staff finds NEI 06-06, Revision 6, dated April 2013, acceptable, with the exception noted above, for the NRC staff to begin the process of formally endorsing this guidance via a Regulatory Guide.
