Dear Chairman Macfarlane:

The Town of Plymouth, Massachusetts, is the host community for the Entergy Pilgrim Nuclear Plant. Entergy submitted a building application for a retaining wall at the Pilgrim Plant that was related to aplan to build an Interim Spent Fuel Storage Installation ("ISFSI"). That requested wall permit was granted by the Building Department on January 2, 2013.

Additionally, Entergy submitted a zoning permit application to build a concrete pad and modular storage units also related to the ISFSI, and that application is still pending.

In light of these requests, and public interest in the ISFSI, the Board of Selectmen of the Town of Plymouth requests a public briefing by the NRC on the ISFSI process, the nature of an NRC review of the installation of an ISFSI, the role of state and local authorities in the approval process, the continuing oversight of the NRC of the ISFSI, and the relationship of the "waste confidence" rule on the development of dry cask storage at existing reactor sites, The Town is concerned about the potential hazards of ISFSIs presented during an unusual event or accident e(g, earthquakes, floods, etc.) and requests that information on that topic be discussed fully. Information on the nature of safety reviews, general and site specific structural considerations, thermal, shielding, criticality, confinement of the nuclear materials used, and quality assurance should also be provided to the public. For example, does the NRC explicitly oversee and review all aspects of the planning for, design of, compliance with regulations affecting dry cask storage development projects at licensed nuclear operating facilities?

A discussion of the specific obligations of Entergy to report to and communicate with the NRC and local and state authorities regarding the plans, progress, problems and other aspects of the Entergy ISFSI project should be included in the public briefing of the Select Board.

Information regarding the dry cask storage projects approved by the NRC and now in place, the problems associated with dry cask storage, as well as the impact of post-Fukushima steps Prinled on lec"yced Paper

Allison M. Macfarlane Chairman implemented and under consideration by the NRC that affect the dry cask storage ISFSI program would be vital to a full understanding of the entire ISFSI program and the effect Entergy's ISFSI development at Pilgrim may have on the public.

Please explain if the dry cask storage process has been approved previously for Entergy at the Pilgrim facility. If so, when and pursuant to what type of review? Was the approval granted pre-Fukushima incidents? How does the Town of Plymouth know that Entergy's casks and other elements of the ISFSI project are safe and appropriate for the Pilgrim site now and in the future? What happens if Entergy's ISFSI installation is faulty? In the event of plant mothballing or closure, is Entergy authorized to continue to implement the ISFSI project at Pilgrim?

Is the "nuclear decommissioning fund" used to develop the ISFSI project? Is an Environmental Impact Statement ("EIS") required before construction begins at a particular site?

If not, why not?

Please provide information on ISFSI projects that have been implemented at other sites; Are they safe? Have any problems, environmental, safety or otherwise, been reported to the NRC? What are the problems?

Thank you for considering the Town of Plymouth's request for a complete and open briefing on the ISFSI licensing and oversight process. We request an opportunity to ask questions of the NRC. Finally, because of actions taking place at the Entergy facility and the apparent construction schedule, we request that the briefing meeting be scheduled as quickly as possible.
