Docket No. 50-443-LR ASLBP No. 10-906-02-LR-BD01 March 11, 2013 MEMORANDUM AND ORDER (Requiring Update of Staffs Projected Schedule)
The Initial Scheduling Order, as amended, provides that, [s]hould the NRC Staffs best estimate of the projected schedule for completion of either its safety or environmental evaluations materially change, the Staff shall so advise as soon as practicable, and in no event later than the next monthly update of disclosures.1 Most recently, on June 4, 2012, the Staff advised the Board that the expected date for completion of the environmental review is April 2013, and that the date for completion of the safety review is to be determined.2 In the February 11, 2013 issue of Inside NRC, however, it is reported that the Staff has delayed the projected date for completion of the environmental review until December 2013.3 The Staff has not so advised the Board.

2 On or before March 15, 2013, the Staff shall advise the Board of its current best estimate of the projected schedule for completion of its safety and environmental evaluations.
Henceforth, the Staff shall make an affirmative representation as to its then-current best estimate of the projected schedule for completion of these evaluations in each of the monthly status reports that the Staff is required to file, in accordance with the Initial Scheduling Order, on the first Thursday of every month.4 It is so ORDERED.
