x UNOPPOSED MOTION BY STATE OF NEW YORK FOR LEAVE TO SUBMIT TWO REVISED EXHIBITS Office of the Attorney General for the State of New York The Capitol State Street Albany, New York 12224

The State of New York respectfully submits this unopposed motion for leave to file two revised exhibits and thereby submit color versions of already-admitted grayscale versions of the two exhibits. The exhibits are based on the same single root document: Enercon, Site Specific MACCS2 Input Data for Indian Point Energy Center, Revision 1 (Dec. 1, 2009) (Enercon MACCS2 Input Data). A grayscale version of the document was produced by Entergy as IPEC00208853, and the document previously has been admitted at NYS00270A & NYS00270B, as well as NYS000211, which is an excerpt of the document. The State recently requested and received the color version of the document from Entergy.

The State submits that good cause exists to grant the motion since the color version of the document will assist the tribunal, the parties, and the public in reviewing the document and its diagrams. No party will be prejudiced because the documents are the same -- except for their color scale.

CONCLUSION For the above reasons, the State respectfully requests that the Board grant this unopposed motion and permit the State of New York to file NYSR0270A & B and NYSR00211. The documents - with exhibit markers - accompany this filing.
