Dear Administrative Judges:
Accompanying this letter is the State of New Yorks updated exhibit list, NYSR21001 dated February 14, 2013.
The exhibit list includes references to exhibits submitted during and following the October-December 2012 evidentiary hearings (exhibits NYS000443 to NYS000473).
In reviewing the exhibit list, we have also corrected certain non-substantive spacing and typographical mistakes and sought to ensure consistency for certain abbreviations or shorthand citations (e.g., NUREG-1930 SER and NUREG-1930 SSER).
Furthermore, we noticed that the States exhibit list previously did not indicate that the DSEIS and FSEIS are applicable to NYS-12C (NYS000132A-D, NYS000133A-J). Those documents, which the State (and NRC Staff) had submitted, were discussed in the States previous submissions in support of NYS-12C. Todays updated exhibit list corrects that inadvertent omission and identifies those exhibits as also applying to NYS-12C.
Finally, the State also submits NYSR00270A-B and NYSR00211. These revised exhibits contain color images and is submitted in place of the earlier version of NYS000270A-B and
2 NYS000211, which contained only gray scale images. Entergy, NRC Staff, and the intervenors do not object to this substitution. In accordance with previous Board directives, a motion for leave to file the two revised exhibits also accompanies todays filings; as noted, the motion is unopposed.
