NRC STAFFS UNOPPOSED MOTION TO FILE CORRECTED EXHIBITS (NRCR00036 AND NRCR00139)
Pursuant to the discussion during the evidentiary hearing in this matter on December 13, 2012, and in accordance with the provisions of 10 C.F.R. §2.323(a), the Staff of the Nuclear Regulatory Commission (Staff) hereby files this unopposed motion to file corrected exhibits and a corrected exhibit list. These exhibits comprise NRCR00036 and NRCR00139. When the original exhibit, NRC000036 was filed, one page of text was inadvertently omitted. When the original exhibit NRC000139 was filed, four pages of a chart were inadvertently omitted.
Corrected copies of these exhibits are attached, along with a revised NRC Staff Exhibit List.
These corrected exhibits are relevant to Contentions NYS-8 (Transformers) and NYS-37 (Alternatives) and the testimony given at the hearing in this matter. Correction of the exhibits will contribute to the development of a clear record, will assist the Board in reaching a decision on the merits, and will not cause undue delay or prejudice to any party. Accordingly, the Staff requests that the Board admit corrected exhibits NRCR00036 and NRCR00139 and the revised NRC Exhibit List, NRCR700001.
