Dear Administrative Judges:

In accordance with the ASLBs directive at the end of last weeks adjudicatory hearings in the above-referenced proceeding, Riverkeeper is writing to inform the ASLB of Riverkeepers position on the timing for responses to Entergys motion for a declaratory order currently pending before the ASLB related to Entergys obligation to obtain a coastal consistency certification pursuant to the federal Coastal Zone Management Act.

Riverkeeper participated in consultations with New York State, Entergy, and NRC Staff relating to this matter. The representations made by the parties in letters submitted to the ASLB today are consistent with Riverkeepers understanding of the parties respective positions. Riverkeeper supports an extension of time in which to file responses to Entergys motion and concurs that, at this time, March 22, 2013 is an agreeable filing date. Thus, Riverkeeper anticipates supporting the States prospective request for additional time.
