Dear Administrative Judges:

On November 29,2012, Entergy Nuclear Operations, Inc. ("Entergy" or "Applicant") submitted a letter to the NRC, clarifying its aging management program for buried piping and tanks and UFSAR Supplement, to address the presence of in-scope underground piping at the Indian Point facility. By letter dated December 6,2012, Entergy submitted its revised testimony on Contention NYS-5 (Exhibit ENTR30373) and various other documents (Exhibits ENT000595 through ENT000601), related to this issue.

The NRC Staff ("Staff') has reviewed Entergy's submittals and has revised the Staff's pre-filed written testimony on Contention NYS-5 to address these matters. Accordingly, the Staff herewith submits the following documents:

1. "NRC Staff's Testimony of Kimberly J. Green and William C. Holston Concerning Contention NYS-5 (Buried Pipes and Tanks)," as revised December 7,2012 (Exhibit NRCR20016);
2. Redline/strikeout version of the NRC Staff's revised testimony (Exhibit NRCR20016),

showing changes from the previous version filed on August 23,2012 (Exhibit NRCR00016);

3. A certificate of service for this transmittal.

Judge McDade December 7,2012 Judge Kennedy Judge Wardwell The Staff is preparing a revised statement of position reflecting these developments, which we will file later today along with a revised list of NRC Staff exhibits.

The Staff intends to offer item 1 above as an exhibit in the evidentiary hearings to be held on Contention NYS-5 on December 10, 2012. Item 2 above is provided herewith solely for the convenience of the Atomic Safety and licensing Board ("Board") and parties, and will not be offered into evidence.
