Completion of final Indian Point Opinion Hi Sherwin, As we discussed on the phone this afternoon, we are working on finalizing the Biological Opinion due to be issued to NRC re. Indian Point on 11/28. Today, we discussed NRC's comments on the draft Incidental Take Statement (ITS). NRC will be proposing some modified language to us regarding compliance with the ITS.

We understand it will take NRC a couple of days to provide us that language. On the call, NRC suggested that the consultation period be extended by 7 days (to December 5, 2012) to allow NRC to provide us this language, for us to consider it and for us to take the final BiOp through our final clearance and signature process. We have no problem with the extension and understand that you have contacted Entergy as well (they are also cc'd here). We are interested in getting the Opinion done as quickly as possible but recognize that taking a few days to address the remaining comments and concerns is worthwhile.

Additionally, we asked you about Entergy's comment, "Entergy also notes that any implementation schedule may need to account for authorizations of other regulators, including NRC" (p. 7 of Entergy's 11/9/12 comment letter). NRC indicated that they did not know what authorization from NRC Entergy may be referring to and that we should ask Entergy for clarification. By including Entergy on this email we are seeking their clarification and hope that they will work with you to provide us an answer indicating what NRC authorizations they are referring to.
