ENDORSEMENT OF SUPPLEMENTAL GUIDANCE TO NEI 09-05, GUIDANCE ON THE PROTECTION OF UNATTENDED OPENINGS THAT INTERSECT A SECURITY BOUNDARY, REVISION 0, DATED NOVEMBER 2012

Dear Mr. Kline:

I am responding to your letter dated November 1, 2012, (Agencywide Documents Access and Management System (ADAMS) Accession Number ML12312A286) in which you requested that the U.S. Nuclear Regulatory Commission (NRC) staff review and endorse Supplemental Guidance to NEI 09-05, Guidance on the Protection of Unattended Openings that Intersect a Security Boundary, Revision 0. Based on the Nuclear Energy Institute (NEI) staff acknowledgement via email (ADAMS Accession No. ML13015A073) that the Supplement contains no sensitive information, and has been publically released and placed in ADAMS (Accession No. ML13022A459).

The NRC has endorsed and considers NEI 09-05 to be adequate guidance for licensees in determining the protection of unattended openings that intersect a security boundary or area.

The NRC staff has reviewed the Supplemental Guidance to NEI 09-05 provided as an attachment to your November 1, 2012, letter. Based on that review, the NRC staff has determined that certain guidance criteria, definitions, and engineering examples contained within the proposed supplement conflict with RIS 2005-04 and existing guidance in NEI 09-05.

No technical basis was provided to change the existing guidance. Accordingly, the NRC is not prepared to endorse the supplemental guidance as currently written.
