Thank you for alerting the NRC of an expected delay in implementing the new Emergency Action Level scheme at Indian Point. We understand that your application estimated an implementation to a scheme based on Nuclear Energy Institute 99-01, Revision 5, "Methodology for Development of Emergency Action Levels," by the end of this calendar year but this date is being deferred for the reasons cited below.

As we discussed, our safety evaluation of June 6, 2012 (ML121180118), approving the proposed scheme change was not based upon a proposed implementation date and, as such, our conclusions remain unchanged.

Please let us know if you anticipate a significant change from a January 2013 implementation date. A copy of this email will be made publicly available in ADAMS.

Implementation of Emergency Action Levels for IPEC Emergency Plan The NRC approved an upgrade of the Emergency Action Level scheme for Indian Point in their letter of June 6, 2012. Entergy had indicated a planned implementation date of December 31, 2012 in our request for approval (Entergy Letter NL-12-025 dated March 16, 2012 (TAC 6392 / 6393). Due to the unforeseen effects of Hurricane Sandy and subsequent holiday seasons the training for our offsite counterparts is currently not in complete and scheduled training may be subject to change. Because of this Entergy wants to advise NRC that implementation may slip until January 2013. The implementation schedule is not a requirement of the NRC approval.
