"While reviewing an order for a Type 9200 Butterfly Valve, it was discovered that some parts [shipped from Marshalltown, Iowa from 2009-present] had not been identified for Commercial Grade Dedication, These parts were considered Essential-to-Function and Were needed for the valve assembly to perform its safety-related function(s).

"[The vendor] then extended its review to all safety-related orders going back to 2009. This review confirmed that the failure to dedicate was not confined to Type 9200 butterfly valves. The beginning of 2009 was selected because [an audit follow-up was] performed in January, 2009. A key point of emphasis during the audit was commercial grade dedication, with a recommended outcome being the addition of guidance on commercial grade dedication with all new quotations. Therefore, the 2009 audit brought clarity and consistency in approach, that was not always applied correctly between January, 2009 thru October, 2012.

"It is [vendor's] opinion that while the affected equipment identified as safety-related was not properly dedicated, the failure to dedicate does not appear to pose an inherent safety risk based on currently available Information.

The reason being that much of the equipment affected by [the vendor's] error were items such as mounting kits, wherein [the vendor] failed to dedicate the hardware used to mount the instrument (i.e., the bracket and screws),

but did properly dedicate the instrument. Additionally, in forming this opinion, [the vendor] has taken into account that there are no known field issues with the affected equipment and all such possibly non-dedicated equipment passed the required standard testing."

Commercial Grade Dedication of Essential-to-Function equipment within certain Fisher valve assemblies, shipped from Marshalltown, Iowa from 2009-present.

A list of possibly affected serial numbers can be found in Table 1 below.

Purpose:

The purpose of this Fisher Information Notice ("FIN") is to alert potentially affected customers that, as of October 25, 2012, Fisher Controls International LLC ("Fisher")

became aware of a possible failure to comply, Fisher is providing this written notice per the requirements of 10 CFR 21.21(b).

Receipt of this FIN does not necessarily mean that the recipient has received subject

.equipment. It is expected that the recipients of this notice will review this information for applicability to their equiment and facilities, and if required, take the appropriate action as described in the 'Action Required' section at the end of this FIN.

Applicability:

This FIN applies to the equipment identified in Table 1, which lists serial, order and Item FISHER] Page 1 of 4

Discussion:

While reviewing an order for a Type 9200 Butterfly Valve, it was discovered that some parts had not been identified for Commercial Grade Dedication. These parts were considered Essential-to-Function and were needed for the valve assembly to perform its safety-related function(s).

Upon discovery of this possible failure to comply, an investigation was performed on all safety-related Type 9200 butterfly valves that were contractually required to be dedicated and had been shipped.

Fisher then extended its review to all safety-related orders going back to 2009, This review confirmed that the failure to dedicate was not confined to Type 9200 butterfly valves, The beginning of 2009 was selected because NUPIC had performed an audit in September 2008 and returned for a follow-up review in January 2009. A key point of emphasis during the audit was commercial grade dedication with a recommended outcome being the addition of' guidance on commercial grade dedication with all new quotations. Therefore, the 2009 audit brought clarity and consistency in approach, that was unfortunately not always applied correctly between January 2009 thru October 2012.

It is Fisher's opinion that while the affected equipment we identified as safety-related was not properly dedicated, the failure to dedicate does not appear to pose an inherent safety risk based on currently available information. The reason being that much of the equipment affected by Fisher's error were Items such as mounting kits, wherein Fisher failed to dedicate the hardware used to mount the instrument (i.e., the bracket and screws), but did properly dedicate the Instrument. Additionally, in forming this opinion, Fisher has taken into account that there are no known field issues with the affected equipment and all such possibly non-dedicated equipment passed the required standard testing.

The following Corrective Actions have been completed or are in process:

@ An internal Corrective Action (CAR# 1570), classified as a Significant Condition Adverse to Quality, has been issued to the Director, Nuclear Business Unit regarding entry of safety related orders, in accordance with Fisher's Quality Program.

  • All shipped safety-related orders requiring dedication activities (going back to 2009) have been reviewed, as described above.

  • This notice was drafted and sent to NRC and all nuclear utilities (including non-US utilities). Additionally, Fisher is contacting each, individual potentially affected utility. This action is expected to be completed by November 16, 2012.

" All pending orders are being reviewed and will be corrected prior to shipment.

" Mandatory enhariced training will be provided to all employees engaged in processing safety-related orders, to ensure that the equipment requiring Commercial Grade Dedication is properly identified and listed on the order.

" A thorough review of the order entry process, Including a mapping of the process, is being conducted, The future, process will Include additional controls and review points, which will be documented In the operating procedure.

" In the short-term pending the completion of the aforementioned corrective actions, the Nuclear Qualification Engineer, the engineer designated for determining which parts are Essentlal-to-Function, will be engaged during the quotation stage of an order to ensure that the proper Essential-to-Function equipment for Commercial Grade Dedication is identified based on the equipment's safety-related function,

" We continue to review all applicable customer purchase orders (from 2009 through the present) to determine whether a failure to comply actually occurred. In an abundance of caution, Fisher.has elected to notify all potentially affected customers via this FIN, understanding that it may eventually be determined that some of the notified customers did not receive affected, equipment.

Action Required:

Fisher will supply properly dedicated equipment, at Fisher's cost, for the affected valve assemblies that are in inventory or in service.

10 CFR Part 21 Implications:

Fisher requests recipients carefully review this notice and take appropriate action In accordance with 10 CFR Part 21.
