Administrative Judges November 9, 2012 Page 2 On July 30, 2012, Entergy filed with the Board a Motion for Declaratory Order that IP2 and IP3 have already undergone the required consistency review under the federal Coastal Zone Management Act for renewal of the IP2 and IP3 operating licenses. Although both of Entergy's filings relate to the New York Coastal Management Program, the Petition to NYSDOS is independent of the Motion for Declaratory Order filed in this proceeding because it concerns questions of state law. Nevertheless, Entergy is alerting the Board to the Petition because it is consistent with the position set forth in Entergys pending motion before this Board that Entergy need not certify that it satisfies the Coastal Zone Management Act for purposes of license renewal for IP2 and IP3.
