MILLSTONE UNIT 1 - DENIAL OF EXEMPTION FROM CERTAIN SECURITY REQUIREMENTS OF 10 CFR PART 73.55 (TAC NO. J00392)

Dear Mr. Heacock:

Dominion Nuclear Connecticut, Inc. is the licensee for Millstone Power Station, Unit 1. By letter dated December 9, 2010, Dominion Nuclear requested an exemption from 10 CFR 73.55(e)(9)(v)(B). The U.S. Nuclear Regulatory Commission (NRC) staff reviewed the exemption request for the Millstone Power Station, Unit 1. Based upon their review, the Commission is denying the requested exemption. The basis for the denial is detailed in the enclosed Safety Evaluation, which has been designated as Safeguards Information and must be withheld from public disclosure in accordance with 10 CFR 73.21(a)(1) and 10 CFR 73.22(a)(1)(vii). You must be in full compliance with 10 CFR 73.55(e)(9)(v)(B) within 30 days of the date of this letter. Additionally, it is our understanding that you currently have implemented, consistent with the Millstone site procedures, compensatory measures for the protection of a vital area. The NRC expects that adequate compensatory measures for the protection of a vital area will remain in place during the 30 day period.

In accordance with 10 CFR 2.390 of the NRC=s ARules of Practice,@ a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRC=s Agency-wide Documents Access and Management System (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
