x MOTION TO STRIKE EXHIBIT NYSR00399 AND REPLACE IT WITH EXHIBIT NYSR20399 On October 5, 2012, the State of New York filed Exhibit NYSR00399, revised testimony of Dr. David Duquette in support of Contention NYS-5. The State filed this revised testimony to avoid motion practice with Entergy on this contention. On Monday, October 15, 2012, the Board advised counsel for the State that the State improperly failed to redact a sentence which, in its redlined version submitted on October 5, the State had intended to redact.
CONCLUSION The State submits this motion to strike Exhibit NYSR00399, and respectfully requests that the Board admit revised exhibit NYSR20399 in its place.
CONSULTATION Not having heard any objections during the hearing discussions of this issue either October 15 or October 16, the State submits that this motion is unopposed.
