Dear Administrative Judges:
The State of New York reached a resolution with Entergy regarding statements that Entergy wished to strike from the Revised Rebuttal Testimony on Contention NYS-5, obviating the need for motion practice on this contention. For the Boards convenience, the State has attached a redlined copy of the original document, which contained the original exhibit number (NYS000399), along with the revised document, which contains new exhibit number (NYSR00442). I had previously advised the Board that I would file this only after resolution of Staffs motion in limine to minimize submissions, but as the Board recently indicated that it may resolve motions in limine at the hearing itself, I am submitting these changes now.
