On October 4, 2012, the State of New York (New York) filed an unopposed motion seeking a modification of the Boards October 4, 2012 Order granting New York leave to file an additional exhibit and cross-examination questions concerning Contention NYS-12C.1 In that Order, we gave the parties until October 9, 2012, to file proposed questions concerning New Yorks newly admitted exhibits labeled NYS000441 and NYS000442.2 In its current motion, New York stated that NYS000442 was not proffered as an evidentiary exhibit in support of a contention, but instead was only proffered in support of its motion for leave to file an additional exhibit and cross-examination questions regarding 1
