On August 22, 2012, the Board issued an order notifying the parties of amendments to the 10 C.F.R. Part 2 regulations.1 The Board encouraged the parties to file a joint motion if the Part 2 amendments made changes to the initial scheduling order (ISO) necessary or appropriate.2 On September 21, 2012, NextEra Energy Seabrook, LLC, the NRC Staff, and the Friends of the Coast and the New England Coalition filed a joint motion to modify the ISO.3 The motion requests that the ISO be brought into conformity with the amendments to Part 2 1

concerning the filing of new contentions.4 Additionally, the motion highlights that the Part 2 amendments altered the scope of the NRC Staffs disclosure obligations.5 The Board GRANTS the joint motion. Section (C) of the ISO is amended to read:
A motion and proposed new contention shall be deemed timely under 10 C.F.R.
§ 2.309(c)(1)(iii) if it is filed within thirty (30) days of the date when the new and material information on which it is based first becomes available to the moving party through service, publication, or any other means.
All other provisions of the ISO remain in effect, except as previously amended by the Boards orders of August 23, 2011 and October 3, 2011.6 In addition, the Board directs the NRC Staff to promptly advise the Board of significant developments (including but not limited to the scheduling of argument or issuance of a decision) 4 Id. at 2-4.
