x UNOPPOSED MOTION FOR EXTENSION OF TIME DUE TO UNAVOIDABLE CIRCUMSTANCES Intervenor the State of New York respectfully requests that the Atomic Safety and Licensing Board grant an extension of time for the State, Riverkeeper, and Interested Governmental Entity, The State of Connecticut, to file a joint reply on Contention NYS-38/RK-TC-5 from October 1 to November 9, 2012 due to a death in State counsels immediate family.

Background

The background of Contention NYS-38/RK-TC-5 was presented to the ASLB in the State, Riverkeeper, and Connecticuts first motion for an extension of time on this contention and will therefore not be repeated here. The Board previously granted these movants an extension of time on this contention; the States request here is unfortunately unavoidable.

Regretfully, on Monday of this week, Assistant Attorney General John Siposs mother passed away. Mr. Sipos is the State of New Yorks lead counsel and counsel for Contention NYS-38/RK-TC-5. As a result of his mothers illness and death, Mr. Sipos was out of the office the week prior to her death and remains out of the office, perhaps through next week. The States expert on this contention is traveling until October 15, the same day the Boards hearing

2 begins. The States request for extension proposes two weeks after the conclusion of the hearings to submit its reply, on November 9, 2012. As the Board recently indicated that this contention will not be heard on Track Ones hearing schedule, the State submits that this extension will not have a material impact on the proceeding.

Conclusion Accordingly, the State of New York respectfully requests that the Board expand the time for Intervenors and Interested Governmental Entity State of Connecticut to file their joint reply to Entergy and NRC Staffs prefiled submissions to November 9, 2012, and request that the deadline for motions in limine be adjusted accordingly. The State thanks the Board for its consideration of this request.
