Nuclear Regulatory Commission ATTN: Document Control Desk Washington, DC 20555 Docket 50-312 Rancho Seco Nuclear Generating Station License No. DPR-54 WITHDRAWAL OF EXEMPTION REQUEST DATED NOVEMBER 19, 2009 Attention: John Hickman On November 19, 2009, the Sacramento Municipal Utility District (SMUD) submitted a request for exemption from portions of 10 CFR 50.75(h)(2) to allow withdrawal of excess funds from SMUD's Decommissioning Trust Fund prior to License Termination.

Because Phase I of the Rancho Seco decommissioning was completed and acknowledged by NRC letter in 2009, and because several of the major projects were completed well below projected costs, SMUD provided sound arguments to support this request when it was submitted.

At that time, SMUD's Decommissioning Trust Fund was widely disparate with the funding estimates based on the then-current Decommissioning Cost Estimate. Much of the funding required by the Estimate is based on the projected cost of disposal of the Class B and Class C low-level radioactive wastes. Since SMUD submitted the exemption request, a new low-level radioactive waste disposal facility has been licensed, which could increase the cost basis for disposal significantly compared to the information in NUREG-1 307, which provided the basis for previous Decommissioning Cost Estimates.

In order'to ensure sufficient funding is-available to comnplefe the future decommissioning of Rancho Seco through-'License TerminatiOn, a.significant change (i,.e., increase) was made to SMUD's Decommissioning-Ceost Estimate to provide for the potentially-.

significant uncertainty in the future cost of low-level radioactive waste disposal.

With this change in the basis for the Decommissioning Cost Estimate, the Decommissioning Trust Fund remains overfunded, but the disparity between the projected costs and the available funding is significantly reduced.

Therefore, SMUD formally withdraws the exemption request "Rancho Seco Nuclear Generating Station Request for Exemption from 10 CFR 50.75(h)(2)" submitted on November 19, 2009.
