TERMINATION OF FACILITY LICENSE NOS. TR-3 AND R-93 FOR THE NATIONAL AERONAUTICS AND SPACE ADMINISTRATION RESEARCH REACTORS AT THE PLUM BROOK REACTOR FACILITY, SANDUSKY, OHIO
Dear Ms. Liang,
The U.S. Nuclear Regulatory Commission (NRC) has reviewed the National Aeronautics and Space Administration (NASA) request (Agencywide Documents Access and Management System (ADAMS) Accession No. ML12268A326), to terminate Plum Brook Reactor Facility (PBRF) License Nos.TR-3 and R-93. In this request, NASA stated that it has completed all decommissioning activities specified in the NRC-approved decommissioning plan (DP) for PBRF and the terminal radiation survey and associated documentation demonstrate that the facility and site are suitable for release in accordance with the requirements for license termination in 10 CFR 50.82(b)(6).
On the basis of decommissioning activities carried out by NASA, the NRC evaluation of the final status surveys and Final Status Survey Report (FSSR), combined with the results of NRCs independent and confirmatory surveys, and 15 on-site inspections, the NRC staff concluded that the site radiological levels are consistent with the provisions of 10 CFR Part 20, Standards for Protection Against Radiation, section 20.1402, Radiological criteria for unrestricted use. As such, we consider the site acceptable for unrestricted use, and Facility License Nos. TR-3 and R-93 are hereby terminated. A technical evaluation report documenting the NRC staffs review of NASAs remediation activities and FSSR is enclosed.
The NRC staff also compared the remaining on-site residual contamination levels against the U.S. Environmental Protection Agency (EPA) trigger levels for soil and maximum contaminant levels (MCLs) for groundwater in the Memorandum of Understanding (MOU) between EPA and NRC on Consultation and Finality on Decommissioning and Decontamination of Contaminated Sites. The NRC staff has concluded that the EPA trigger levels for soils and MCLs for groundwater were not exceeded and no consultation is required in accordance with Section V.C.2 of the MOU.
In connection with the license termination, we are enclosing two copies of Amendment No.18 to Indemnity Agreement No. D-3. Please sign and return one copy to this office.
Also enclosed is a copy of the Notice of License Termination, which is being sent to the Office of the Federal Register for publication.
