Dear Administrative Judges:

The State of New York reached a resolution with Entergy regarding certain exhibits and statements that Entergy wished to strike from the Revised Statement of Position and Rebuttal Testimony on Contention NYS-8, obviating the need for motion practice on this contention. For the Boards convenience, the State has attached redlined copies of the original documents, which contain the original exhibit numbers (NYS000413 and NYS000414), along with the revised documents, which contain new exhibit numbers (NYSR00413 and NYSR00414). In addition, the State will be filing revisions to Contention NYS-5 following resolution of the NRC Staffs motion in limine, and at that time, the State will file a revised exhibit list addressing these changes to NYS-8 and changes, if any, to NYS-5.
