ENCLOSURE 2 TELECONFERENCE REGARDING BIOLOGICAL OPINION FOR NESTING SEA TURTLES AT ST. LUCIE
SUMMARY
MAY 17, 2012 By letter dated April 25, 2012, the U.S. Fish and Wildlife Service (FWS) issued a biological opinion (ML12117A436) regarding nesting sea turtles for a seawall installation project that Florida Power & Light Co. (FPL) is undertaking to repair storm damage and protect the St. Lucie Plant, Units 1 and 2 (St. Lucie), discharge canal from future storms. Term and Condition 6 of the biological opinions incidental take statement directs the U.S. Nuclear Regulatory Commission (NRC) to arrange a meeting between representatives of the NRC, FPL, FWS, and the Florida Fish and Wildlife Commission (FWC) to discuss and clarify the sea turtle protection measures stipulated in the biological opinion. The NRC arranged a call for representatives of each agency or company listed in the biological opinion. However, representatives from FWC from Inwater Research Group, which conducts the St. Lucie sea turtle capture program and nesting surveys were unable to participate in the call. The May 17, 2012, teleconference fulfilled Term and Condition 6 of the biological opinion.
During the teleconference, FWS asked FPL if the project was on schedule to have all construction activities completed by June 30, 2012, as stipulated in the biological opinion. FPL indicated that the project was on schedule.
FWS asked if any sea turtles had deposited nests in the construction zone to date. FPL indicated that one leatherback turtle had deposited a nest near the construction zone in an area that would not be affected by construction activities, and the FWC had given FPL permission to continue work. Another sea turtle nest had been relocated with FWC permission prior to the commencement of work activities on the day the nest was identified.
FWS asked if FPL had begun to install the sheetpile for the seawall. FPL indicated that all of the sheetpile is installed and that workers are currently installing anchors, which should be completed by the first or second week in June. Workers will then install concrete caps. FPL noted that FPL staff has weekly meetings to talk about the seawall installation project schedule.
FPL should be able to assess whether construction would need to extend beyond June 30 once all the anchors are installed. If FPL needs to extend the work schedule beyond June 30, FPL will notify FWS and NRC as soon as possible after that decision is made. FWS indicated that if FPL needs to work beyond June 30, FPL should notify FWS and NRC by June 15, 2012, to ensure enough time to discuss additional mitigation measures (as appropriate) and modify the biological opinion.
FWS asked about the status of the dune planting. FPL indicated that the majority of the dune planting is complete.
FWS asked about FPLs working hours for construction activities. FPL indicated that work hours are generally from 7:00 a.m. to 7:00 p.m. Sea turtle surveys are completed prior to 7:00 a.m. If a nest or false crawl is identified, FPL notifies FWC by 7:30 a.m., and work does not start until this notification is made.
FPL noted that it has been reporting nests and false crawls to the FWC each morning before work starts. FPL asked FWS if FWS wants FPL to notify FWS also. FWS indicated that notification is only necessary if an incidental take occurs.
