On May 16, 2012, the Nuclear Regulatory Commission forwarded a draft Confirmatory Order with regard to the Tennessee Valley Authority's planned submittal for a license amendment request to transition BFN Units 1, 2, and 3, to the National Fire Protection Association (NFPA) Standard 805 fire protection program in accordance with 10 CFR 50.48(c).

TVA consents to the issuance of the referenced Confirmatory Order, effective immediately upon its issuance and, by doing so, agrees to waive the right to request a hearing on all or any part of the Confirmatory Order (See Enclosure).

There are no new regulatory commitments contained in this letter.

CONSENT AND HEARING WAIVER FORM The Tennessee Valley Authority (TVA), hereby agrees to comply with the terms and conditions of the Confirmatory Order arising out of a commitment made in a letter from TVA dated January 13, 2012. The Tennessee Valley Authority understands that the Confirmatory Order will be immediately effective upon its issuance. By signing below, Tennessee Valley Authority, consents to the issuance of the referenced Confirmatory Order, effective immediately upon its issuance and, by doing so, agrees to waive the right to request a hearing on all or any part of the Confirmatory Order.
