UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION ATOMIC SAFETY AND LICENSING BOARD Before Administrative Judges:

Ann Marshall Young, Chair Dr. Paul B. Abramson Dr. Richard F. Cole In the Matter of: Docket No. 50-293-LR ENTERGY NUCLEAR GENERATION ASLBP No. 12-921-08-LR-BD01 COMPANY AND ENTERGY NUCLEAR OPERATIONS, INC.

(Pilgrim Nuclear Power Station) May 17, 2012 ORDER (Granting NRC Staffs Unopposed Motion for Extension; Seeking Input from Parties)

Earlier on this date, this Licensing Board was established to adjudicate the Jones River Watershed Association (JRWA) and Pilgrim Watch (PW) Request to Reopen, for a Hearing, and to File New Contentions , filed May 14, 2012. On May 15, 2012, the NRC Staff filed a request for extension of time to respond to this filing, asking to extend the deadline from May 29 to June 8, 2012.1 The Staff indicates that the other parties herein do not oppose the motion, noting that Petitioner-Intervenors condition their consent on it not being construed as agreeing to any near-term granting of the applied-for license renewal at issue herein, prior to full litigation and resolution of all outstanding issues, including pending contentions and appeals.2 1

NRC Staffs NRC Staffs Unopposed Motion for an Extension of Time to Respond to Jones River Watershed Association and pilgrim Watchs May 14, 2012, Request to Reopen, for a Hearing and to File New contentions (May 15, 2012) [hereinafter Staff Motion]; Jones River Watershed Association (JRWA) and Pilgrim Watch (PW) Request to Reopen, for a Hearing, and to File New Contentions and JRWA Motion to Intervene On Issues Of: (1) Violations of State and Federal Clean Water Laws; (2) Lack of Valid State § 401 Water Quality Certification; (3)

Violation of State Coastal Zone Management Policy; and (4) Violation o NEPA (May 14, 2012).

2 Staff Motion at 2.

2 For good cause shown, the Licensing Board GRANTS the Staffs motion, with the understanding that Petitioner-Intervenors maintain their opposition to issuance of the sought license (a matter now before the Commission) prior to resolution of pending matters.
