Before this Board is a motion 1 filed by Beyond Nuclear, Citizens Environment Alliance of Southwestern Ontario, Dont Waste Michigan, and the Green Party of Ohio (collectively, Intervenors) requesting that we vacate and reschedule an oral argument scheduled for Friday, May 18, in Port Clinton, Ohio. 2 This Board issued an order on March 28, 2012, setting Intervenors proposed Contention 5, regarding shield building cracking, for oral argument. 3 Subsequently, on April 5, 2012, FirstEnergy Nuclear Operating Company (FENOC) submitted responses to requests for additional information and filed an amendment to its License Renewal Application (LRA),

addressing issues relating to shield building cracking and providing a new Aging Management 1

Intervenors Unopposed Motion to Vacate and Reschedule Oral Argument on Proposed Contention No. 5 (May 14, 2012) [hereinafter Motion].

Program called Shield Building Monitoring Program. 4 FENOC then filed an unopposed motion seeking to supplement its answer opposing admission of proposed Contention 5, arguing that these recent filings had rendered Contention 5 moot. 5 Neither Intervenors nor NRC Staff filed any response to this supplemental answer.

On May 14, 2012, Intervenors filed the instant unopposed motion to vacate and reschedule the oral argument. 6 Intervenors contend that oral argument would be premature and wasteful, because they plan to amend proposed Contention 5 based on FENOCs LRA amendment, and any such filing would not be due until June 4, 2012. 7 Therefore, Intervenors ask that we cancel the oral argument scheduled for Friday, May 18, 2012, and reschedule it at a later date when the proposed Contention 5 may be finally considered for admissibility to this proceeding. 8 Inasmuch as the pending Contention 5 is likely to be amended or new contentions based on FENOCs April 5, 2012 LRA amendment are likely to be proposed, the Boards March 28, 2012 Order setting proposed Contention 5 for oral argument is vacated, and the oral argument scheduled for Friday, May 18, 2012, in Port Clinton, Ohio, is cancelled. Upon receipt of Intervenors amendments to Contention 5 and the responsive pleadings of FENOC and the NRC Staff, this Board will evaluate whether holding oral argument on the issues presented by 4

those pleadings would be helpful. Should we decide to schedule another oral argument, we will issue an Order to that effect and publish a notice in the Federal Register. 9 It is so ORDERED.
