ORDER (NRC Staffs Monthly Status Report to Include DSEIS)
On September 15, 2010, the Board issued an order specifying that the NRC Staff should submit a monthly status report that includes, inter alia, the Staffs best estimate of the dates it expects to issue the draft and final version of the Supplemental Environmental Impact Statement. Initial Scheduling Order at 11 (Sept 15, 2010) (ISO) (unpublished). Recently, however, the Staffs monthly reports have failed to include any estimate as to when the Staff expects to issue the draft supplemental environmental impact statement (DSEIS). See e.g.,
Staff Status Update at 1 (Apr. 18, 2012). Meanwhile, on November 18, 2011, the Board denied the San Luis Obispo Mothers for Peace (SLOMFP) motion to file a new contention stating, inter alia, that [i]f the DSEIS fails to capture and address any information that SLOMFP believes to be new and significant, then SLOMFP may file a NEPA contention at that time. LBP-11-32,
74 NRC __, __ (slip op. at 16-17) (Nov. 18, 2011). The date the DSEIS is issued is an important milestone, particularly relevant to the future schedule of this proceeding.
Accordingly, the Staff is ordered to comply with the requirements of the ISO in all respects - including inclusion of its then-current estimate of the date of issuance of the DSEIS.
If the Staff determines, at any time, that it will not issue a DSEIS, the monthly status report shall indicate that none is intended to be issued.
