NRC STAFFS THIRD STATUS REPORT IN RESPONSE TO THE ATOMIC SAFETY AND LICENSING BOARDS ORDER OF FEBRUARY 16, 2012 In accordance with the Atomic Safety and Licensing Boards (Board) Order (Granting NRC Staffs Unopposed Time Extension Motion and Directing Filing of Status Updates)

(Order), issued on February 16, 2012, the NRC Staff (Staff) herewith provides the following information:

1. As indicated in the Staffs previous status reports,1 Entergy Nuclear Operations, Inc. (Entergy or Applicant) submitted additional information to the Staff on February 17, 2012, concerning its Reactor Vessel Internals Aging Management Program and Inspection Plan.2 The Staff is continuing its review of that information, and plans to issue requests for additional information (RAIs) to the Applicant within the next two weeks (i.e., on or about May 15, 2012).

As the Staff has stated previously, the Staff will be unable to file its testimony and state its 1

position on Contention NYS-25 (Reactor Vessel Internals) and the related portion of Contention NYS-38/RK TC-5 until it completes its review of this matter.3 The Staff will provide further information to the Board and parties concerning this matter as its review progresses. As the Staff has stated previously,4 a deferral of the Staffs filings on Contention NYS-25 and the related portion of Contention NYS-38/RK TC-5 should not affect the litigation of any other portion of Contention NYS-38/RK TC-5 or any other admitted contention.

2. As the Staff has indicated previously, the Staff does not currently anticipate issuing any requests for additional information concerning the Applicants metal fatigue calculations;5 in addition, the Staff does not anticipate addressing those calculations in a supplemental safety evaluation report.
3. The Staff plans to reinitiate consultations with the National Marine Fisheries Service (NMFS) regarding its recent listing of the Atlantic sturgeon as an endangered species under Section 7 of the Endangered Species Act (ESA). The Staff does not anticipate that this development will affect the planned issuance of a Draft Supplement to the Staffs Final Supplemental Environmental Impact Statement (FSEIS) on other matters.
4. The Staff anticipates issuing the Draft FSEIS Supplement on or before May 31, 2012; see Tr. 1107. The Draft FSEIS Supplement is expected to address certain information regarding aquatic impacts. As the Staff has stated previously, issuance of the Draft FSEIS Supplement should not affect the litigation of any admitted contention other than Riverkeeper Contention EC-8.6 3

Staffs First Report, at 2. The Staff has previously estimated that it will issue a Supplement to the Safety Evaluation Report (SER) to address these matters in August 2012. See Second Report, at 2.

The Staff presently has no further information regarding the projected SER Supplement issuance date, pending its receipt and review of the Applicants answers to the Staffs planned RAIs.

5. The Staff is not currently aware of any other matter that has the potential to further delay this proceeding. In accordance with the Boards direction (Order, at 2), the Staff will notify the Board as soon as it becomes aware of any event with potential to alter the hearing schedule in this proceeding.
