Dear Mr. Provenzo:

This responds to your letter dated April 13, 2000, regarding the presence of any federally listed threatened or endangered species and/or designated critical habitat for listed species in the vicinity of the new Wastewater Treatment Plant for the Town of Plymouth at the Camelot Industrial Park in Plymouth, Massachusetts.

No federally listed or proposed threatened or endangered species and/or designated critical habitat for listed species under the jurisdiction of the National Marine Fisheries Service are known to exist in the immediate project area. However, endangered and threatened sea turlles and whales are known to occur in the waters off the coast of Plymouth. Treated effluent will be discharged into the marine environment through the existing outfall and is restricted to 1.75 mgd, with the excess discharged to the infiltration basins. In order to minimize the potential impact of the effluent on threatened or endangered species, strict adherence to water quality standards criteria under the Clean Water Act should be required.

No further consultation pursuant to Section 7 of the Endangered Species Act of 19i3, as amended, is required. Should project plans change or new information becomes available that changes the basis for this determination, then consultation should be reinitiated.
