Dear Mr. Heacock:
The Region I Field Office, NRC Office of Investigations (OI), initiated an investigation (Case No.
1-2011-023) on February 23, 2011, to determine whether a contractor working for Day &
Zimmerman (D&Z) at the Millstone Nuclear Power Station was discriminated against as the result of raising a safety concern. Specifically, the contractor stated that as a result of reporting a safety matter regarding a co-worker, he/she was subjected to a hostile work environment and eventually laid off. Based upon the evidence developed during the investigation, the NRC did not substantiate that the contractor was discriminated against. Rather, the contractor was laid off in lieu of being terminated for sleeping on the job.
Please note that final NRC investigation documents, such as the OI report described above, may be made available to the public under the Freedom of Information Act (FOIA) subject to redaction of information appropriate under the FOIA. Requests under the FOIA should be made in accordance with 10 CFR 9.23, Requests for Records, a copy of which is enclosed for your information.
