RESPONSE TO NUCLEAR ENERGY INSTITUTE LETTER REGARDING REGULATORY ISSUE RESOLUTION PROTOCOL ISSUE CLOSURE FORM FOR TOP NOZZLE STRESS CORROSION CRACKING

Dear Mr. McCullum:

This letter responds to the Nuclear Energy Institute (NEI) letter submitted to the U.S. Nuclear Regulatory Commission (NRC) regarding the Regulatory Issue Resolution Protocol (RIRP),

Issue Closure Form for Top Nozzle Stress Corrosion Cracking (SCC), dated February 22, 2012 (ML120540821). The purpose of the NEI letter was to submit the closure form for documenting the resolution of the RIRP Top Nozzle SCC issue, which has resulted from numerous and detailed technical and regulatory discussions between NRC and industry in the form of public meetings and formal communications since early 2010.

The NRC staff has reviewed the closure form and determined that it accurately documents the resolution of the RIRP Top Nozzle SCC issue. The Top Nozzle closure is consistent with the NEI guidelines established in the Used Fuel and Transportation Issue Resolution Protocol, A Methodology for Resolving Issues with Generic Implications, NEI 10-03, Revision 0. The Used Fuel Storage and Transportation Issue Closure Form, Issue Number I-10-01 (ML12108A180) will document closure of the Top Nozzle SCC issue and will constitute a durable record, in the interim, until such time as NRC issues a generic communication. NRC intends to issue a Regulatory Issue Summary (RIS) as the final generic communication. The need for the RIS was discussed during a public meeting with NEI and industry on February 14, 2012 (ML12074A012) and on a follow-up telephone call with the NEI Dry Storage Cask Task Force and industry representatives on March 19, 2012 (ML12094A164).
