Dear Mr. Gibb:

Enclosed please fin d five copies of the Updated Final Exercise Report for the Indian Point Energy Center radiological emergency preparedness Plume Pathway Exercise conducted on December 3, 2008. This report. dated June 20, 2010, is being re-issued because a number of related out-of-sequence drills and demonstrations were completed in the fall of 2009 and these are now incl uded in the report. The previous report, dated September 18,2009, should be replaced with this version.

The State of N ew York and local emergency response organizations successfully dem onstrated the capabili ties to implement their off-site radiological emergency response plans and procedures, based on 'the evaluation ofth is exercise by the Regional Assistance Committee and a team of Federal evaluators. There w re no deficiencies; nine Areas Requ iring orrective Act io ns were identi fied, 2 of which have been already corrected as noted in the report.

State and local preparedness is adequate to protect the health and safety of the public living in the vicinity of the Indian Point NPS and will provide reasonable assurance that appropriate measures can be taken offsite in the event of a radiological emergency.
