Dear Administrative Judges:
The State has now received and is in the process of reviewing NRC Staff's motion for reconsideration of the ASLB's March 16, 2012 ruling on intervenors' motion to compel. The Staff motion concerns the schedule for pre-trial submissions for Contentions NYS-38/RK-TC-5 and NYS-25 (Staff Motion at 2-5) and discusses Staff's response to the ASLB's discovery ruling (Staff Motion at 1, n. 1).
While the State does not oppose the Staff's motion, the State wishes to examine the implication for other scheduling issues. Accordingly, the State respectfully asks that the intervenors be permitted the opportunity to file a response by Monday, March 26, 2012.
