INDIAN POINT ENERGY CENTER UNITS 2 AND 3 - RESPONSE TO NRC REQUEST FOR ADDITIONAL INFORMATION REGARDING OPERATOR MANUAL ACTIONS AND NOTIFICATION OF FOLLOWUP INSPECTIONS

Dear Mr. Ventosa:

Thank you for your letter dated March 1, 2012, (ADAMS Accession No. ML12074A028) that provided your response to a request for additional information regarding operator manual actions (OMA) of our letter dated February 1, 2012 (ML12031A176). Our review of your letter determined that you intend to achieve full compliance with Title 10 of the Code of Federal Regulations, (10 CFR) Part 50, Appendix R,Section III.G.2, because all reliance on denied OMAs will be eliminated.

We will begin a review of the implementation of your corrective actions to restore full compliance with Title 10 CFR, Part 50, Appendix R Section III.G.2, during an onsite inspection led by Mr.

Dan Orr from the U.S. Nuclear Regulatory Commission (NRC) Region I Office. The inspection will be conducted in accordance with IP 71152, Problem Identification and Resolution, Section 02.03, Annual Follow-up of Selected Issues. The onsite inspection will occur the week of April 23, 2012. A specific objective of the inspection is to verify that your plans for achieving full compliance with fire protection regulations are entered into your corrective action program, compensatory measures remain in place and are appropriate, and the schedule for restoration to full compliance is commensurate with the risk significance. We will continue to follow your progress and completion of corrective actions with additional inspection. The NRC will inform Entergy of each additional inspection activity.

Mr. Dan Orr will contact you with specific document requests prior to the onsite inspection and to ensure the availability of knowledgeable plant staff and licensing organization personnel to serve as points of contact during the inspection. We request that during the on-site inspection, you ensure that copies of all corrective action documents, including associated analyses, evaluations or documentation regarding the actions necessary to restore full compliance with Title 10 CFR, Part 50, Appendix R Section III.G.2 be readily accessible for inspection.

Personnel should be available at the site during the inspection to identify through circuit diagrams and walkdowns the circuits of concern for each unapproved OMA as it relates to a fire area or zone that is not currently in compliance.

This letter does not contain new or amended information collection requirements subject to the Paperwork Reduction Act of 1995 (44 U.S.C. 3501 et seq.). Existing information collection requirements were approved by the Office of Management and Budget, under control number 3150-0011. The NRC may not conduct or sponsor, and a person is not required to respond to, a request for information or an information collection requirement unless the requesting document displays a currently valid Office of Management and Budget control number.

In accordance with Title 10 CFR, Part 2.390 of the NRCs Rules of Practice, a copy of this letter will be available electronically for public inspections in the NRC Public Document Room or from the Publicly Available Records (PARS) component of the NRCs document system (ADAMS).
