Dear Mr. Dodds:

At your request, to update Entergy's files, I would like to take this opportunity to update you on the status of the above-referenced license and permit federal consistency determinations. On February 3, 2006, Entergy Nuclear Generation Company (Entergy) requested that a federal consistency review be conducted by the Massachusetts Office of Coastal Zone Management (CZM) of the NRC Operating License for the Pilgrim Nuclear Power Station. The consistency review was initiated on February 3, 2006, and a public notice of the review was published in the Executive Office of Environmental Affairs MEPA EnvironmentalMonitor,with a 21-day public comment period.

A concurrence determination finding that the license was consistent with the enforceable policies of the Massachusetts Coastal Program was issued on July 11, 2006. Until such time as CZM is notified that a change has occurred to the license reviewed for the July 11, 2006 concurrence, or until a new license application is submitted, the concurrence determination remains valid.

CZM also issued a federal consistency concurrence for the nuclear station's NPDES permit (MA0003557) on August 29, 1994, following a 21-day public comment period following notice in the MEPA EnvironmentalMonitor. Prior to the issuance of the concurrence determination, CZM received a copy of the Massachusetts Department of Environmental Protection's 401 Water Quality Certificate for the NPDES permit modification on July 8, 1994. The concurrence was issued to Dr.

E.T. Boulette of the Boston Edison Company, then operator of the Pilgrim Nuclear Power Station.

It is our understanding that the permit has not been renewed since 1994 but has been administratively extended each year since then. Again, until such time as CZM is notified that a change has occurred to the license reviewed for the 1994 concurrence, or until a new license application is submitted, the concurrence determination remains valid.

As stated in the concurrence documents, if either the license or permit is modified in any manner, including any changes resulting from permit, license or certification revisions, including those ensuing from an appeal, or the project is noted to be having effects on coastal resources or uses that are different than originally proposed, it is incumbent upon the proponent to notify CZM and submit an explanation of the nature of the change pursuant to 15 CFR 930. CZM will use this information to determine if further federal consistency review is required.
