Dear Ms. Vietti-Cook:
On March 8, 2012, the Jones River Watershed Association and Pilgrim Watch filed a motion to reopen the record of the Pilgrim license renewal proceeding for hearing on a new contention. Expressing uncertainty as to the correct forum, the Petitioners filed this motion before both the Commission and Atomic Safety and Licensing Board. Because the Atomic Safety and Licensing Board has resolved all matters previously before it and terminated the proceeding (LBP-12-01, Jan. 11, 2012), jurisdiction properly lies with the Commission, and Entergy intends to address its answer to the Commission. Moreover, as this motion primarily seeks to raise matters concerning NRC interaction with other agencies and is filed so late in this proceeding, Entergy respectfully submits that the motion should not be referred back to an Atomic Safety and Licensing Board, but instead should remain before the Commission for prompt decision.
