Orf, Project Manager St. Lucie Plant Licensing Branch II-2 Division of Operating Reactor Licensing Office of Nuclear Reactor Regulation Phone: (301) 415-2788 Unit 1 Westinghouse calculations CN-TAS-08-36, Rev.1 provided a justification in paragraph 4.4.7 for not including the seismic error. It should be noted that there is no automatic plant shutdown subsequent to an earthquake even if it exceeds OBE levels and that the plant is allowed to operate for aftershocks (with amplitudes less than OBE) as well. In addition, it will take several hours after an earthquake occurs to determine whether or not the earthquake exceeded the OBE level. Safety related instrument functions, that must remain operable following events postulated to address the phenomena in 10 CFR 50, Appendix A, criterion 2, should account for the effects of such phenomena in establishing the safety-related settings. Inclusion of seismic error or a justification based on technical reasons is requested.
