Dear Mr. Martin:

Westinghouse Electric Corporation sold its Distribution and Control Business Unit (DCBU) to Eaton Corporation effective as of February, 1 1994. The assets of the former business unit, that included the former Westinghouse AR relays, were transferred to Cutler-Hammer, a subsidiary of Eaton Corporation. Westinghouse, and later CBS, entered into Technology Transfer and Supplier and Vendor agreements in 1994. Within the terms of those agreements, Westinghouse retained the rights to sell certain original safety-related DCBU products to the nuclear power industry.

Subsequent agreements have remained in effect since that time.

Westinghouse Electric Company retains ownership of all original equipment qualification testing and qualification documents for products provided by DCBU. Through the various agreements, Westinghouse Electric Company also has access to design drawings and documentation related to, but not limited to, the AR relays. These documents, as well as any required further testing, are the basis for the Westinghouse Commercial Dedication process for AR relays. Westinghouse commercially dedicates the Cutler-Hammer AR relays at its Nuclear Parts Operations (NPO) facility in New Stanton, PA. The commercial dedication process confirms that the relays meet the qualified design requirements and critical characteristics.

In summary, Westinghouse NPO procures commercially manufactured AR relays from Cutler-Hammer and dedicates them for 1E Safety Related application under the Westinghouse IOCFR50 Appendix B program for the nuclear industry.
