Dear Administrative Judges:
The State of New York along with Riverkeeper, Inc. respectfully submits this letter following up on its letter of last evening and in further response to the Atomic Safety and Licensing Boards December 14, 2011 order. Regretfully, discussions with NRC Staff about the scope of mandatory disclosures for Contention NYS-38/RK-TC-5 concluded with no resolution at approximately 3:45 p.m. today. The State and Riverkeeper intend to file a motion to compel by the close of business on Monday.
