Dear Administrative Judges:
The NRC Staff ("Staff") wishes to inform you of a recent development that is relevant to and may affect litigation of Contention NYS-25 (Reactor Pressure Vessel and Internals) in this proceeding.
On September 28, 2011, Entergy Nuclear Operations, Inc. ("Entergy" or "Applicant") submitted its Reactor Vessel Internals Inspection Plan (ADAMS Accession No. 11280A121), in which it addressed the Staff's evaluation of MRP-227, as it had committed in Commitment No. 30.
During the Staff's review of that Inspection Plan, the Staff has identified certain questions related to the Applicant's plans to address MRP-227 -A, which was issued in December 2011 by the Electric Power Research Institute. The Staff held a telephone conference call with the Applicant on January 12, 2012 to discuss this matter, as described in the attached "Summary of Telephone Conference Call" (January 27,2012) (ADAMS Accession No. ML12024A207). As indicated therein, the Applicant plans to submit additional information regarding its Reactor Vessel Internals Aging Management Program and Inspection Plan by February 17, 2012.
The Staff currently expects that it may need to issue requests for additional information ("RAls")
to the Applicant following the Staff's receipt of the Applicant's February 17 submittal, and that the Staffs review of this matter may be the subject of a Supplement to the Safety Evaluation Report for the Indian Point license renewal application. In addition, the Staff may find it necessary to request leave to defer filing its testimony and statement of position on Contention
Judge McDade January 27,2012 Judge Lathrop Judge Wardwell NYS-25 until these issues have been resolved. The Staff will discuss this matter with the other parties in the coming days, prior to filing any motion before the Board.

SUMMARY
OF CONFERENCE CALL HELD ON JANUARY 12. 2012, BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION AND ENTERGY NUCLEAR OPERATIONS. INC., CONCERNING THE REACTOR VESSEL INTERNALS PROGRAM AT INDIAN POINT NUCLEAR GENERATING STATION, UNITS 2 AND 3 Representatives of the U. S. Nuclear Regulatory Commission (NRC or the staff). and representatives of Entergy Nuclear Operations, Inc., (Entergy or the applicant), held a conference call on January 12,2012, to discuss the applicant's aging management activities for the reactor vessel internals (RVI) at Indian Point (IP) Nuclear Generating Station, Units 2 and 3.
These activities consist of the RVI Program, which was submitted to the NRC as part of License Renewal Application Amendment 9 by letter dated July 14, 2010, and the RVI Inspection Plan, which was submitted to the NRC by letter dated September 28. 2011.
By letter dated August 22, 2011, the applicant stated. "Following issuance of MRP~227 ~A, Entergy will review the inspection plan to determine the need for revision, and will modify the inspection plan to include the necessary revisions, if any." MRP~227-A was issued by the Electric Power Research Institute (EPRI) in December 2011. Therefore, the staff inquired if the applicant was aware that MRP-227 -A was issued, whether the applicant had reviewed MRP~227 ~A. and when the applicant planned to address any differences between MRP-227-A and IP's RVI Program and RVI Inspection Plan. The applicant indicated that it was in the process of reviewing MRP-227 -A ana would notify the staff of its plan and schedule to address any necessary revisions to its RVI Program and RVI Inspection Plan based on the issuance of MRP-227-A. With respect to two plant-specific action items for which the information was not provided in the IP RVI Inspection Plan, both of which require plant specific acceptance criteria or analyses for particular components, the applicant indicated that the Pressurized Water Reactor Owners Group (PWROG) is in the process of developing generic guidance for developing the criteria or analyses for these items, and that Entergy would defer providing the response for these items until the PWROG completes its generic work.

Subsequent to the teleconference. Entergy contacted the NRC license renewal project manager for IP and indicated that Entergy would submit a letter by February 17, 2012, that would provide necessary revisions to the IP RVI Program and RVllnspection Plan based on the issuance of MRP~227-A.
