x STATE OF NEW YORK, ENTERGY NUCLEAR OPERATIONS, INC.,

AND NRC STAFF JOINT STIPULATION As authorized by the Board's July 1,2010 scheduling order, Applicant Entergy Nuclear Operations, Inc., Entergy Nuclear Indian Point 2, LLC, and Entergy Nuclear Indian Point 3, LLC

("Entergy"), the Petitioner-Intervenor State of New York ("the State"), and the U.S. Nuclear Regulatory Commission Staff ("NRC Staff') submit the following joint stipulation of issues not in dispute with respect to the below-designated admitted contentions and the parties agree, as to the following, there is no issue that needs to be heard:

(1) As indicated in the State's prefiled submissions for Contention NYS-5, NYS-5 addresses external corrosion of buried pipes and tanks, and the State's previously expressed concerns regarding internal corrosion of buried pipes and tanks are no longer at issue in this contention. (This stipulation does not affect Riverkeeper's contentions concerning flow accelerated corrosion (TC-2) or groundwater (EC-3).)

(2) As indicated in the State's pre filed submissions for Contention NYS-5, NYS-5

addresses buried components (i.e. pipes and tanks), and the State's previously expressed concerns regarding the spent fuel pool transfer canals are no longer at issue in this contention.

Entergy avers that aging management of spent fuel pool transfer canals is within the scope of the Structures Monitoring Program (License Renewal Application section B.l.36) and not the Buried Piping and Tanks Inspection Program (License Renewal Application section B.l.6).

(3) As indicated in its pre filed submission for Contention NYS-16116A116B, the State has chosen not to pursue the claim that Entergy's air dispersion model is being used beyond its range of validity and does not accurately predict the geographic dispersion of radionuclides released in a severe accident and, therefore, it is no longer at issue in this contention. See State of New York Initial Statement ofPosition Contention NYS-16116A116B ("NYS-16B) (NYS000206) at pp. 6-7, n.6. NYS-16B includes the claim that the FSEIS violates the National Environmental Policy Act, NRC regulations, and Council on Envirorunental Quality regulations because it accepts an underestimation of the 2035 population within 50 miles ofIndian Point likely to be exposed to radiation during a severe accident. In NYS-16B, the State still asserts two significant errors in the population estimate: (1) failure to account for census undercount; and (2) failure to account for the commuter population present within the 50 mile zone of Indian Point.
