Dear Sir or Madam:
By letters dated July 11 and August 5, 2011, Indiana Michigan Power Company (I&M), the licensee for Donald C. Cook Nuclear Plant (CNP), submitted the 60-Day Response to Bulletin 2011-01, Mitigating Strategies.
By email dated November 14, 2011, the Nuclear Regulatory Commission (NRC) communicated to CNP a request for additional information (RAI).
This RAI required a response to two issues which involve testing and inventory of communications equipment, and verification that our letter of agreement is current with Berrien County Emergency Management and the Berrien County Sheriffs Department. to this letter provides an affirmation statement regarding the information in this letter. provides I&M's response to the NRC RAI.
This letter contains no new commitments.

By e-mail dated November 14, 2011, the Nuclear Regulatory Commission (NRC) communicated to CNP a request for additional information (RAI).
This RAI required a response to two issues which involve testing and inventory of communications equipment, and verification that our letter of agreement is current with Berrien County Emergency Management and the Berrien County Sheriff's Department. Each RAI item is restated below followed by the corresponding I&M response.
NRC RAI Question 1:
Describe in detail the testing and inventory of communications equipment to ensure that it is available and functional when needed:
The bulletin requested that each licensee describe in detail the testing and control of equipment supporting the mitigating strategies to ensure that it will be available and functional when needed. Communications equipment needed to support the mitigating strategies was described in the NRC Safety Evaluation documenting the NRC review of your response to Section B.5.b of the Interim Compensatory Measures Order (EA-02-026), and typically includes radios, satellite phones, spare batteries, and chargers. The NRC staff could not determine if you performed activities to ensure that communications equipment will be available and functional when needed.
I&M Response CNP's credited communications equipment is pagers and radios.
Plant response personnel are initially notified via Emergency Response Organization (ERO) pagers. The ERO pagers (not procured specifically for B.5.b) are tested weekly.
Fire Protection communications equipment is inventoried by procedure on a monthly frequency.
The procedure verifies the location and inventory of radios that have been established for use by off-site responders when they respond into CNP.
These radios are maintained in chargers at the first access point to CNP (Post 1) to be picked up by the off-site responders for use on site. These radios operate on the same frequency as the radios used for daily business by CNP's dedicated Fire Brigade. The Fire Brigade also carries pagers, which are tested weekly. The radios staged for use by off-site responders are inventoried monthly, as stated above, and verified functional as they are used during various evolutions such as annual drills.
Security communications equipment is inventoried following annual Force-On-Force Drills. On a monthly basis, the batteries in the radios.in service inside the Protected Area are rotated with spare batteries from the radios that have been on the charging system located outside of the Protected Area.

Verify that your letter of agreement with Berrien County Emergency Management and memorandum of understanding with the Berrien County Sheriff Department are current.
The bulletin requested that each licensee describe in detail how it ensures the availability of off-site support, including a listing of periods of lapsed contractual agreements. In response to the bulletin, you stated that the agreements for both of the off-site organizations listed above were last validated on February 1, 2010, and that they are revalidated on an annual basis.
Since your bulletin response was dated July 11, 2011, this implies that either the date of the last validation is incorrect or that the validation period has been exceeded.
I&M Response Availability of off-site support, specifically, Berrien County Emergency Management and the Berrien County Sheriff's Department, is documented via agreements that are renewed and signed every two years (most recently on February 1, 2010, as stated).
Additionally, in accordance with the Emergency Plan Management procedure, letters of agreement are reviewed with off-site agencies as part of the annual Emergency Plan review. The most recent review of the Cook Emergency Plan is documented as January 29, 2011.
