In accordance with 10 C.F.R. § 2.338(g), the December 21, 2011 Joint Motion for Approval of Settlement Agreement and Dismissal of New York State Contention 24 in this relicensing proceeding is granted. The mutual resolution of this Contention and the avoidance of unnecessary litigation is in the public interest. Accordingly, the Settlement Agreement is approved, and New York State Contention 24 is dismissed.
